Terms of Service — ClearSay

1. Acceptance of Terms

By downloading, installing, or using ClearSay ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

ClearSay is an English pronunciation and grammar coaching application. The App uses artificial intelligence to analyse your speech recordings and provide CEFR-rated feedback. ClearSay is published by Nothing But Meow LLC ("we", "us", "our").

3. Eligibility

You must be at least 13 years old to use ClearSay. By using the App, you represent that you meet this requirement.

4. User Accounts

You may use ClearSay anonymously for limited recordings.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.

5. Acceptable Use

You agree not to:

Use the App for any unlawful purpose.
Submit recordings containing hate speech, illegal content, or content that violates third-party rights.
Attempt to reverse-engineer, hack, or disrupt the App or its infrastructure.
Scrape, crawl, or systematically extract data from the App.
Circumvent subscription or quota restrictions.

6. Subscriptions and Payments

ClearSay offers free and paid subscription tiers.
Subscriptions are billed through the App Store (iOS) or Google Play (Android) by their respective billing systems.
Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
Refunds are subject to the refund policy of the relevant app store.

7. AI-Generated Content

Feedback provided by ClearSay is generated by AI and is for educational purposes only. It does not constitute professional language instruction. Results may vary and are not guaranteed to be accurate.

8. Intellectual Property

The App and its content are owned by Nothing But Meow LLC and protected by copyright and other laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. User Content

You retain ownership of your audio recordings. By submitting recordings, you grant us a limited license to process them solely for the purpose of providing the coaching service. See our Privacy Policy for data retention details.

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI FEEDBACK WILL BE ACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTHING BUT MEOW LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App settings.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms. We will notify you of material changes via in-app notification. Continued use after the effective date constitutes acceptance.
